WAIVER AND RELEASE OF LIABILITY AGREEMENT
This Waiver and Release of Liability Agreement ("Agreement") is made effective as of the date signed below, by and between KW & AM Holdings, LLC DBA Be Well Studio ("Studio") and the undersigned participant ("Participant").
1. Assumption of Risk
I, the undersigned, acknowledge and fully understand that engaging in physical activities such as those offered by KW & AM Holdings, LLC DBA Be Well Studio, including but not limited to [yoga, barre, pilates, high-intensity interval training, strength training], involves inherent risks of injury, illness, disability, and even death. These risks may include, but are not limited to:
Muscle strains, sprains, or tears
Broken bones
Joint or back injuries
Heart attack, stroke, or sudden death
Other physical or emotional harm
I voluntarily accept these risks and agree to participate in activities with the knowledge that I may experience injury, illness, or death as a result of these activities.
2. Release of Liability
I hereby release, discharge, and hold harmless KW & AM Holdings, LLC DBA Be Well Studio, its owners, directors, instructors, employees, agents, and any associated parties from any and all liability, claims, demands, or causes of action that may arise from my participation in any of the Studio's programs or use of its facilities. This includes claims arising from negligence or the actions of the Studio, its employees, or third parties, and includes claims related to injury, illness, disability, or death.
3. Medical Disclaimer
I acknowledge that KW & AM Holdings, LLC DBA Be Well Studio is not responsible for determining whether I am physically fit to participate in its activities. I represent and warrant that I am in good physical condition and have no medical condition, injury, or impairment that would prevent me from safely participating in the Studio's activities. I understand that it is my responsibility to consult a physician before beginning any fitness program and I do so at my own risk.
4. Sickness and Fitness to Participate
I agree that I will not attend the Studio or participate in any activities if I am feeling unwell, have a fever, cough, or other symptoms of illness, or if I believe I may have been exposed to a contagious condition (including but not limited to COVID-19, influenza, or other infectious diseases). I understand that participating in physical exercise while ill can increase the risk of injury, illness, and other serious health complications. I take full responsibility for ensuring that I am healthy and physically able to participate on the day of each session.
5. Virtual Classes and At-Home Participation
If I choose to participate in virtual classes offered by KW & AM Holdings, LLC DBA Be Well Studio from my home or any other remote location, I understand that I do so at my own risk. I acknowledge that KW & AM Holdings, LLC DBA Be Well Studio is not responsible for providing a safe environment or monitoring my form during virtual classes. I accept full responsibility for ensuring that the space I use is safe, free of hazards, and suitable for physical exercise. I hereby release KW & AM Holdings, LLC DBA Be Well Studio from any and all liability for any injuries, damages, or accidents that occur during virtual sessions, including but not limited to claims related to equipment, environment, or improper form.
6. Injuries or Issues Unrelated to Physical Activity
I understand and agree that KW & AM Holdings, LLC DBA Be Well Studio is not responsible for any injuries, accidents, or issues that may occur within its premises but are unrelated to the physical activities offered. This includes, but is not limited to, injuries caused by slips, trips, falls, malfunctioning equipment, or any other hazards present in the Studio. I acknowledge that it is my responsibility to use caution and be aware of my surroundings while on the premises, and I release KW & AM Holdings, LLC DBA Be Well Studio from any claims related to non-activity-based incidents, including but not limited to personal injury or property damage.
7. Emergency Medical Treatment
In the event of an emergency, I authorize KW & AM Holdings, LLC DBA Be Well Studio and its representatives to obtain necessary medical treatment for me. I agree to be responsible for any and all costs associated with such treatment.
8. Indemnification
I agree to indemnify and hold harmless KW & AM Holdings, LLC DBA Be Well Studio, its owners, employees, and representatives from any and all claims, damages, expenses, or liabilities (including attorney fees) arising out of my participation in activities at the Studio, virtual classes, or use of the Studio's equipment or facilities, whether caused by negligence or otherwise, including claims related to injury, illness, disability, or death.
9. Photography/Video Release
I consent to the use of photographs or video recordings taken at KW & AM Holdings, LLC DBA Be Well Studio during workouts, which may be used for promotional purposes, including but not limited to advertising, social media, and website content.
10. Minors
If the participant is under the age of 18, a parent or legal guardian must sign this agreement. The undersigned parent or guardian acknowledges the minor's participation in the activities and assumes all risks and liabilities on behalf of the minor as set forth in this agreement.
11. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles.
12. Severability
If any part of this agreement is deemed unenforceable or invalid, the remainder shall continue to be enforceable to the fullest extent permitted by law.
13. Acknowledgment of Understanding
I have read this waiver and release of liability, fully understand its terms, and sign it voluntarily, understanding that I am giving up substantial rights, including the right to sue for injury, illness, disability, or death.
